Appeal to the Supreme Courtimage

According to the Act for the Establishment of and Procedure for Intellectual Property and International Trade Court (Second Issue) B.E. 2558 (Section 40 paragraph 1) stipulates that “an appeal against any judgment or order of the Court of Appeal for Specialized Cases shall be submitted to the Supreme Court and the provisions of the Civil Procedure Code and/or the Criminal Procedure Code shall apply mutatis mutandis”

In civil cases, the Civil Procedure Code section 247 paragraph 1 stipulates that “The petition of the judgment or order of the Court of Appeal may be done when permission has been granted by the Supreme Court. In Paragraph 2 the application for the permission to present a petition shall be done by submitting a claim together with the petition to the Court of First Instance who issued the judgment or order in such case within one month from the date that the judgment or order of the Court of Appeal for Specialized Cases is readout. The Court of First Instance shall, without delay, send such claim together with the petition to the Supreme Court and the Supreme Court shall, without delay, complete its consideration for such claim.”
