According to the Act for the Establishment of and Procedure for Intellectual Property and International Trade Court, B.E. 2539 (1996) amended by the Act for the Establishment of and Procedure for Intellectual Property and International Trade Court, (Second Issue) B.E. 2558 (2015), Section 38 stipulates that “an appeal against any judgment or order of the Intellectual Property and International Trade Court shall be submitted to the Court of Appeal for Specialized Cases and the provisions of the Civil Procedure Code and/or the Criminal Procedure Code shall apply mutatis mutandis.”
The Court of Appeal for Specialized Cases was established by the Act for the Establishment of the Court of Appeal for Specialized Cases B.E. 2558 (2015). It adjudicates the appeals against judgments and orders of specialized Courts, namely Intellectual Property and International Trade Courts, Tax Courts, Labor Courts, Bankruptcy Courts, and Juvenile and Family Courts. Therefore, an appeal against any judgment or order of the Central Intellectual Property and International Trade Court now shall be submitted to the Court of Appeal for Specialized Cases, not to the Supreme Court as before.
